Introduction
Please read these Terms and Conditions carefully before using our websites and any Product sold by, or online Service, provided by InSky LLC (“InSky”, “we”, “our” or “us”) that post a link, or refer to these Terms and Conditions (the “Service”). By visiting or otherwise using the Service in any manner, or by purchasing and/or using any InSky Products or related Services, you agree to the Terms posted at the time and any applicable Additional Terms (defined below), to be bound by them, and that you have read and understood them.
If we amend, adjust, or change these Terms, we will notify you at your provided email address and provide fourteen (14) days to review the changes. By continuing to use our products or Services after such notice, you agree to be bound by the amended Terms. If you do not agree with the changes, you must stop using our products and Services.
These Terms affect your legal rights, responsibilities, and obligations and govern your use of the Service and any other InSky Products. They are legally binding, limit InSky’s liability to you, and require you to indemnify us and to settle certain disputes through individual arbitration. If you do not wish to be bound by these Terms and any Additional Terms, please do not use our Services or purchase our Products.
Product Descriptions
We strive to accurately describe our Products and Services; however, we do not warrant that such specifications, pricing, or other content is complete, accurate, reliable, current, or error–free.
You acknowledge that InSky drones are professional-grade unmanned aircraft systems designed for industrial and commercial use. They are not consumer or hobbyist devices. No guarantees are made that development-stage products will become commercially available, or that available versions will meet anticipated specifications under your specific operational conditions.
Our products and Services may be subject to U.S. and international export restrictions and requirements. You are solely responsible for researching and complying with all applicable laws before purchasing, importing, exporting, operating, or reselling InSky products. InSky reserves the right to refuse or cancel any order in its sole discretion. Orders are offers to purchase subject to our acceptance.
If a purchased product materially fails to conform to the description provided by InSky, your sole remedy, to the extent permitted by law, shall be to return it for cancellation and receive a credit for the purchase price.
Safety, Operation, and Compliance Requirements
- Regulatory Compliance: You are solely responsible for ensuring that your operation of any InSky Product complies with all applicable aviation and unmanned aircraft system regulations, including FAA regulations in the United States, local aviation authority regulations in other countries, and related federal, state, and local laws.
- Operator Qualifications: You represent and warrant that only properly trained and authorized personnel will operate InSky Products. Use by unlicensed or untrained operators is strictly prohibited.
- Safety Obligations: You are responsible for conducting pre-flight checks, routine maintenance, and ensuring Products are operated only in safe weather, airspace, and terrain conditions, and only for lawful purposes.
- Prohibited Uses: InSky Products may not be used for unlawful surveillance, weapons delivery, military combat unless expressly permitted by contract, or any other purpose prohibited by applicable law. InSky products are not designed, intended, or authorized for use in safety-of-life applications — unless a particular InSky product is expressly identified and sold by InSky as suitable for such applications.
Limited Warranty
Except as expressly stated in a separate written warranty accompanying a purchased drone, InSky drones and related products are provided “AS IS” and “AS AVAILABLE.”
This limited warranty covers only manufacturing defects in materials and workmanship for a period specified in your purchase agreement. It does not cover damage resulting from misuse, accidents, weather, acts of God, improper maintenance, modifications, or operation outside of documented guidelines.
InSky does not warrant or guarantee that Products will meet specific performance benchmarks in your specific operating conditions. The sole remedy shall be repair, replacement, or refund, at InSky’s discretion.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, InSky AND ITS PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. You acknowledge that unmanned aircraft operations are inherently risky and YOU ASSUME ALL RESPONSIBILITY AND RISK.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL InSky OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. If InSky is held liable despite these exclusions, your sole and exclusive remedy shall be limited to the amount you paid InSky for the product or service giving rise to the claim.
Insurance Requirements
You agree to obtain and maintain adequate liability insurance covering drone operation. Proof may be requested by InSky prior to delivery.
Export Control Compliance
InSky products are subject to U.S. export control laws (EAR and, as applicable, ITAR). You agree not to transfer InSky products in violation of applicable export control laws.
Governing Law and Enforceability
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law. If any provision is invalid, the remaining provisions remain enforceable.
Arbitration & Dispute Resolution
Disputes will first be addressed by good-faith negotiation and mediation (AAA). If unresolved within sixty (60) days, they will be settled by confidential individual arbitration in Florida under the Federal Arbitration Act (AAA rules). YOU WAIVE JURY TRIAL AND CLASS ACTION PARTICIPATION. InSky may seek legal or equitable remedies in court to protect its interests.
